Granted unto Samuel Corning & Nathll Howard the Son & Son in Law of the Sd decd having given bond with Sureties for their adminttcon according to Law. [305:1] Essex Ss: By the Honble Bartholmew Gedney Esqr Judge of Probate of wills and Granting Letters of administrattcon within Sd County March ye 18: 1694/5 The Estate of Ensigne Samuel Corning Late of Beverly decd intestate being Committed to the administracon of Samuel Corning Son of the decd and Nathaniel Howard who have Exhibited an inventory of Sd Estate and Rendred an accompt of the Same as on File with the Records of this Court and also have Exhibited Two agrements under the hands & Seals of all [the] Parties Concerned in the Sd Estate as a Full & Final Settlemt and distribution of the Said Estate which agrements bear date the 7th March 1694/5 and are acknowledged before Bartholmew Gedney Esqr Judge as above Said upon which a quietus is given forth to the Sd Administrators as appears next after the Agrements following this Entry Settlement of Ensign Cornings Estate Be it knowne unto all men by these presents that wheras by Certaine Articles of agrement which are Extant under the hands of us Samuel Corning Secundos Nathaniel Howard Senr & Nathaniel Stone Sen and our Seales: We were engaged in the Said writing dated the Sevent[h] of March 1694/5 to make adivision of the lands that did formerly pertaine to Ensigne Samuel Corning Senr our decd Father as in the Said Writing will more at large appear we have divided the sd lands [ ]Eleventh day of March in the year of our Lord God Sixteen hundred Ninety four five in manner and forme as here followeth --- Imprs That Nathaniel Howard Senr his part of the Same lands is all the land Northeasterly from a stone placed about Seventeen foot Southerly from Nathaniel Howard Junr his shop at the Country roads by beverly meetinghouse & from the Said Stone on aline unto the South Corner of the Said Howards well & from thence to run Streight with the line of the sd Howard house lott on a Right line unto the River so that he the Said Howard dose with the Consent of the Said Samuel Corning Secundos & Nathll Stone [ ] take all the Land on the north or northeasterly side of the line Aforesd which was possessed by the Said Ensigne Samuel Corning, as his full proportion & Share of the lands Aforementioned : And the Said Nathaniel Stone part: of the said lands is one pole & an half wide of land next to Capt [John] Higginsons Acre of land till it Comes to the Lower End therof unto astake and an heap of Stones; & runing from thence on a streight line unto Another Stake & an heap of Stones which is the Eastermost Corner bounds of Caleb Wallis his two acres of land even all the lands on the Sout[h]ermost Side of the lines Aforesd the which Said Ensigne Corning possessed : he said Stone doth with the Consent of the Said Samuel Corning Take as his full proportion & Share of the lands Aforementioned & also with the Consent of the Sd Nathaniel Howard: And the Said Samuel Corning Secund[ ] doth with the Consent of the Sd Nathaniel Howard and of the Said Stone take all the Remainder there of and the house & barne & trees their upon Standing; as his full proportion & Share of the Said lands : And also the Said Stone and the Said Howard doe give up all their right in: and for ever quit Claim unto Four Acres & an half of marsh at Longham which was our Said Fathers formerly : And we do by these presents all of us for our Selves Heires Exectrs & Admrs for Ever: Engadge Each to the other to Stand to this our present division & Every part therof as Witness our hands and Seales the day and year above mentioned ------------------ turn over [305:2] Mentioned Signed Sealed & Delivered Nathaniel Hayward^Senr and a Seal in the presence of us Nathaniel Stone Senr & a Seal William Raymont Junr Samuel Corning Junr & a Seal Nehemiah Hayward Nathaniel Hayward Nathaniel Stone & Samuel Corning James Ketle personally Appearing Acknowledged the Above written Instrument to be their Act and Deed this 11th day of March 1694/5 before me Bartho. Gedney J : Pr----------- Agremt of ye Parties relating to Ensign Cornings Estate These Articles of Agreement made the Seventh day of march in the year of our Lord God Sixteen hundred ninety & fourfive : Between Elizabeth Corning the Widow & Relict of Samuel Corning Senr late of Bevrly in the County of Essex in New England decd on the one part: and Samll Corning Secundus ; son of Sd Samuel Corning Senr and Nathaniel Howard Senr in Right of his wife Elizabeth: and Nathaniel Stone Senr in Right of his wife Remember Wittnesseth that we have all of us agreed as here followeth (viz) ------ that the debts and funeral Charges due out of the Said Ensigne Cornings Estate Shall first of all be paid out of the Said Estate by the Said Cornings Adminis[trators] out of his moveable Estate and a faire accompt therof Rendred unto all the Parties Concerned in the Said Estate and the Said Elizaeth Corning Widow shall in Full of her Right and Title of dower in & unto sd Estate have one half of all the Moveable Estate A foresaid after the debts be paid: and also that they Shall be to her use and behoof for ever: and that the other half of Sd Moveable Estate Shall be Equally divided between the Sd Samuel Corning: Nathaniel Stone & Nathaniel Hayward in the Right of their wifes aforementioned and also that the Said Widow Shall during the term of her widowhood have the use and Improvement of all the housing and lands mentioned upon the Inventory of ye Said Ensigne Cornings Estate and also the use and Improvement of two Acres and a quarter of meadow ground at Longham alwaies provided that She Shall Continually keep the Said housing & fences in as good tenantable Repair - as they now are ---- And that the Sd Widow Shall make no Strip or waste upon the Sd premises & it is further agreed upon: That their Shall be Adivision of the Said Lands (The first Convenient time that may be : made in manner following: the Sd Nathaniel Hayward shall have one quarter part of the Sd Lands Laid out to him as his proper right in the Sd Estate on the North side of Sd Lands & Shall therin have Six foot of land front at the high way aded to the front at the high way that he now hath Runing on a Strait line from the high way & Coming to a point on the [South?] Corner of his well and the Sd Samuel Corning Shall have one half of the Said Lands being the midle part of the Same together with the housing theron Standing as his proper right in the Sd Estate: & the Sd Nathaniel Stone Senr Shall have the other quarter part of the Said lands layed out to him on the Southside of the Sd lands & therin Shall have one pole & halfe wide of Land runing & buting upon the highway as his proper right in the Said Estate: and unto the due performance of all [every] & Singuler [the] Articles of agreement herein mentioned we the parties above mentioned doe by these presents receiprocally & Enterchangably all of us bind our Selves heirs and assignes each unto the other In Wittness wherof we have set there unto our hands & Seales the day & year herein First abovementioned in this Instrument (the words Heirs [&] assigns enterlined before Sealing) -------------- Sealed and Delivered in the presence of Samuel Hardie: Jenkin Williams [305:3] Jenkin Williams & William Raiment Junr Signed Eliza Corning & a Seal Nathaniel Hayward & a Seal Elizabeth Corning Nathaniel Hayward Samuel Corning Secu[ ] & a Seal Samuel Corning and Nathaniel Stone per= Nathaniel Stone Senr & a Seal sonally Appeared & Acknowledged the Above Written Instrument to be their Act and deed This Eleventh day of March 1694/5 Before me Bartho Gedney JP------ Administrators of Cornings Estate yr Quietus Bartholmew Gedney Esqr Commissionated by his Excellency [ ] William Phips Knight Capt General & Governer in chief in and over their Majties province of the Massashusetts bay in New England with the advice and Consent of the Councel for the Granting the probate of Wills and Letters of Administrattcon & ca within the County of Essex. To all unto Whome these presents Shall Come Greeting ----- Know yee that it hath been made appear before me that Samuel corning & Nathaniel Hayward Administrators of all & Singuler the goods chattels rights & Credits of Ensigne Samuel Corning late of Beverly in the Sd County of Essex Yeoman decd. Intestate have well and faithfully administred the goods chattels rights and Credits of the Sd decd which he had whilst he lived & at the time of his death that have Come to the hands and Possession of the Sd Administrators & have made & Rendred Aplain and True Accompt of their Sd Administrattcon Annexed to these presents in full of the Inventory of the Same by them Exhibited into the Court of probate within Sd County and remaining in the Registry therof I do there fore discharge the Said Administrators from all other accompt or [reconing] in this behalf to be rendred or given so far as it concernes my office and so long as they Shall Remain unconvict of any fraud or deceit et Salvo [jire Cujus cunq] I do finally dismiss them by these presents in Testimony whereof I have [ ] Caused [ ] Seal of the Said Court of probate to be hereunto Affixed Dated at Salem the eighteenth day of March Anno Dome. 1694/5 in the Seventh year of their Majties Reign Bartholmew Gedney Stephen Sewal Regr/
